By engaging with Hello Modern’s services, you agree to the following terms and conditions:

1. Scope of Services

Hello Modern provides professional website design and development services, built with modern design principles and good SEO practices. Our services include:

  • Website Design & Development – Custom, responsive websites tailored to client needs.

  • Ongoing Maintenance (Optional) – Monthly website updates, security checks, and performance monitoring.

  • Graphic Design – Creative design services such as logos, branding elements, and supporting visuals.

All services are delivered with the goal of providing clients with functional, visually appealing, and user-friendly websites that align with their business objectives.

2. Payments

  • Full upfront payment is required before any work begins.

  • We do not accept partial or installment payments.

3. Refund Policy

  • A full refund is available if the client cancels within 48 hours of payment.

  • No refunds are available after 48 hours or once work has commenced.

4. Hosting & Domain Services

  • Hello Modern provides free hosting and a domain name for the first year.  ⚠️ Note: Hosting is not included with our E-Commerce packages.

  • Annual renewal fees apply after the first year (amounts will be stated in the client’s contract).

  • Clients will be notified 30 days before renewal is due.

  • If payment is not received at least 2 days before the due date, hosting will be cancelled and the website taken offline.

5. Client Responsibilities

  • The client must provide all necessary content, artwork, branding, and images before work can begin.

  • If sufficient information is not provided, Hello Modern may use stock images and/or generic content based on available information. Any updates or replacements to such content will be billed separately.

  • Delays in providing required content will result in project delays.

  • Projects can only commence once all required information has been received.

6. SEO Disclaimer

  • Hello Modern follows SEO best practices when building websites.

  • However, no guarantees are made regarding search engine rankings or specific results.

7. Intellectual Property

  • Ownership of the website will be transferred to the client once the project is completed and full payment has been received. The website will remain under Hello Modern’s managed platform account, with the client receiving full access to manage and update their site. If the client opts for a maintenance package, Hello Modern will provide ongoing updates and support.

  • Hello Modern retains the right to showcase completed projects in our portfolio and marketing materials.

8. Limitation of Liability

Hello Modern will not be held liable for:

  • Indirect, incidental, or consequential losses.

  • Business interruption, revenue, or profit losses.

  • Third-party service interruptions or failures (including but not limited to Wix Studio, PayFast, Google, or hosting providers).

9. Termination of Services

  • Hello Modern reserves the right to suspend or terminate services if the client breaches these Terms & Conditions.

10. Governing Law

  • These Terms & Conditions are governed by the laws of South Africa.

  • Any disputes will be resolved within South African jurisdiction.
